Dear Readers,
I raised concerns regarding the current proposed Draft EIA 2020 Notification of the BJP government at the Andhra Pradesh Congress Committee meeting via a Zoom APCC meeting on 1st August, 2020. (I had also made a mention of the fact that the central government's proposed draft EIA 2020 is problematic on Facebook on an earlier occasion).
On the request of our party's state president (ie., PCC President), I emailed further details to the PCC, and to others. This included a link to a letter written to the MoEFCC by our party colleague; a link to a letter signed by 100 activists; a link each, to a talk by an environmentalist and a lawyer.
As you might have noticed on social media, our party has taken up the matter in a big way.
It is my sense that the said draft notification was either Covid-economic-panic-induced, or highly opportunistically crafted at a time when scrutiny is at a bare minimum.
The following is the content of my email to the MoEFCC, sent in my individual and independent capacity, to the email id that calls for public comments:
"To Whom It May Concern At The MoEFCC, India:
SUBJECT: WITHDRAW THE PROPOSED DRAFT EIA NOTIFICATION, 2020
1. I have perused, with great alarm and concern, a draft document prepared by a person or person at the MoEF, which intends to replace the existing EIA notification under the EPA, and to replace it with this set of writings which could be entitled anything thereafter. EIA would certainly not be an appropriate moniker.
2. I write in my individual and independent capacity as a legal expert and specialist.
3. I urge you to Immediately withdraw the document entitled Draft EIA Notification 2020, that you have circulated for public comments.
4. The concern and alarm arises from the fact that the proposed draft notification is Unconstitutional, goes against the intention of the EPA under which it is being sought to be framed, and introduces new policy changes which go way beyond the scope of the MoEFCC.
5. I will not go into further details in this letter, but let it not be said, by the international community, that India allowed its MoEFCC to define Border Areas.
6. I seek the immediate withdrawal of this draft notification.
7. I recommend that all concerns that need to be addressed, on the part of the economy, be not panic-drived due to Covid-19. I further recommend that you have transparent, verifiable, and well-publicised dialogue with the Finance and Commerce ministries, and bring their legitimate views only, to the table of the MoEFCC.
8. The MoEFCC ought to then consult, and take on board, all views, and tow the line of the new world order, keeping in mind inter-generational equity. This is not the way.
