a brief note regarding the latest Office of Profit controversy in India

Office of Profit

The latest news is that the Election commission of India has (apparently, without following proper procedures to arrive at its conclusion), recommended the disqualification of some AAP-party Delhi MLAs for holding offices of profit because they were appointed as parliamentary secretaries by chief minister kejriwal.

This is bizarre.

The concept of parliamentary secretaries is a well-entrenched part of our parliamnetary and legislative system.

However, as we have been saying for a few decades, there need to be some changes brought about in the system (and, like anything else, the system needs to be constantly reivewed with changing times).

For example, as far as the central government and parliament is concerned, i was surprised, when i accompanied visiting relatievs on a tour of parliament house in the early 2000s, to find that there was an office room right next to mrs sonia gandhi's office room inside parliament house, that had my father's name on it. this was because he, as a sitting member of parliament, was the parliamentary secretary. this was in the space for the offices of our INC party in parliament. other parties also have similar offices in parliament. there are set criteria, it's all allowed, all legal, no office of profit alleged.

HOWEVER, the criteria are such that many (smaller) parties do not have such office spaces, and there is no such space for independent MPs inside the parliament house.

This point can be discussed and acted upon if required, but i think disqualifying AAP MLAS from the delhi assembly on such grounds as are being cited would be an illogical step.
